The Nation, according to Hayes, is a society whose residents enjoy the full benefits of citizenship and civil rights. Hayes argues that the United States is comprised of both a colony and a nation. The criminal justice is designed to reinforce this division and protect the Nation. The residents of the Nation are overwhelmingly middle and upper class whites.
