The Colony, according to Hayes, is a society whose residents lack full citizenship are controlled from without by the Nation. Hayes argues that the United States is comprised of both a colony and a nation. The criminal justice is designed to reinforce this division and protect the Nation. The residents of the Colony are overwhelmingly black and poorer than their white counterparts.
