The criminl element of the murder victim is a recurring idea. There are three murder victims in DEATH OF AN EXPERT WITNESS. None of the three is a "totally innocent" victim. The first murder, and one that is only peripherally considered, is that of the young woman found in the clunch field. The young woman who is murdered has been involved with a man other than her husband—it's not explicit in the book as to whether she actually commits adultery, but she must have known her husband well enough to know that he would not approve of her behavior. Of course, flirting with a man who is not one's husband, or even adultery, is not deserving of the punishment of death, but the victim is not totally innocent.
