A SUIT BROUGHT BY Simon & Schuster against Scholastic and a former S & S executive, claiming wrongful solicitation of employees in breach of the executive's contract, was largely rejected last month by a New York Supreme Court judge. Only the breach of contract complaint against the executive was allowed to stand, but Judge Herman Cahn said that if it went to trial, S & S would receive only nominal damages.
The suit, launched three years ago, concerned Margery Mayer, president of the Ginn division of S & S between 1987 and 1990, who, with a team of employees and an investment of $50 million...
