1/3 With time running out before the Nov. 5 general election, John Derus asked the Minnesota Supreme Court on Monday to reconsider its dismissal of his petition challenging the primary election that gave the DFL state Senate nomination to Linda Higgins.
In a petition filed Monday, Derus says that the state Constitution gives the Legislature sole authority to determine the merits of his challenge.
When the Supreme Court dismissed his challenge this month, it "misapplied and overlooked" provisions of the Constitution, state statutes and its own precedents, according to the petition.
