Secretary of the Treasury Salmon P. Chase relied on the opinion of Attorney General Edward Bates when attempting to settle, in 1863, whether an African American could be the master of a vessel. Bates' lengthy reply considered several aspects of the question, and determined that a free man of color born in the US could be a captain. This apparently ignored the US Supreme Court's verdict in the Dred Scott case. Transcribed historical documents are included.
