From its creation to the way it held its final meeting, the Berger Commission was so flawed that its findings have to be thrown out, says the lawsuit filed by lawyers for A.L. Lee Memorial Hospital this week.
Lee Memorial, which the Berger Commission - formally known as the state's Commission on Health Care Facilities in the 21st Century - recommended converting to an outpatient clinic, announced Tuesday that it was suing the state, Gov. Eliot Spitzer, the state health department and the state health commissioner.
